Terms of Service

These Terms of Service (“Terms”) govern your access to and use of LightSkye Console (“the Platform”), operated by LightSkye Energy (“we”, “us”, “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

Description of Service

LightSkye Console is a business operations platform for solar energy companies, providing lead management, team operations, analytics, and third-party integrations. The Platform is hosted at console.lightskye.com and is accessible through modern web browsers.

Account Terms

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized access to or use of your account.
  • One person or automated agent per account, unless otherwise approved by us.
  • You must be 18 years of age or older to use the Platform.

Invitation-Only Access

Access to the Platform is by invitation only. Invitations are issued at the sole discretion of platform administrators. We reserve the right to revoke access at any time, with or without cause or prior notice.

Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable laws
  • Attempt to gain unauthorized access to any part of the Platform, other accounts, or connected systems
  • Interfere with or disrupt the Platform, its servers, or connected networks
  • Transmit malware, viruses, worms, or any other harmful or destructive code
  • Use automated tools to scrape, crawl, or extract data from the Platform without prior written authorization
  • Reverse engineer, decompile, or disassemble any part of the Platform
  • Share your account credentials with unauthorized individuals
  • Use the Platform to store or transmit sensitive personal data beyond what it is designed to handle
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity

Intellectual Property

The Platform, including its source code, design, logos, documentation, and all associated intellectual property, is owned by LightSkye Energy. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Platform solely as intended and in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Platform, nor may you create derivative works based on it, without our prior written consent.

Your Data and Content

  • You retain ownership of the data and content you input into the Platform.
  • You grant us a limited license to process, store, and display your data as necessary to provide and improve the Platform.
  • You are responsible for the accuracy, legality, and appropriateness of data you input.
  • We may generate anonymous, aggregated analytics from platform usage to improve our services. Such analytics will not identify you or your organization.

Privacy

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you acknowledge and consent to the collection and use of information as described therein.

Third-Party Services

The Platform may integrate with third-party services (such as Google, HubSpot, and others). Your use of those integrations is subject to the respective third party’s terms of service and privacy policies. We are not responsible for the practices or content of third-party services.

Availability and Support

  • We aim to maintain high availability but do not guarantee that the Platform will be uninterrupted, timely, or error-free.
  • Scheduled maintenance will be communicated in advance when reasonably possible.
  • Support is provided at our discretion and may vary based on your organization’s service arrangement.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIGHTSKYE ENERGY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY.

Indemnification

You agree to indemnify, defend, and hold harmless LightSkye Energy and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

Termination

  • We may suspend or terminate your access to the Platform at any time, with or without cause or prior notice.
  • You may request account deletion by contacting us at the email address below.
  • Upon termination, your right to use the Platform ceases immediately. Any provisions of these Terms that by their nature should survive termination will survive.

Modifications to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform or via email. Your continued use of the Platform after any modifications constitutes your acceptance of the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LightSkye Energy operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of that jurisdiction.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
